Each count is punishable by up to three years in prison and a $25,000 fine. Cook County Judge James Linn will decide whether Smollett will serve concurrent or consecutive sentences. Prosecutors claimed that the former “Empire” star made false reports to police when he claimed to be the victim of a hate crime in January 2019.
